Yes, but, I think that we have also another problem: few developers.
That's why, I propose not to develop everytihing, but pay IBM for a part, and dedicate free developer to the others.On the other hand, I think another thing:
What is software? i.e., what is a program or operating system?.
I think that we all agree that it is not just what the user can see, but also the internals. This means that two programs behaving in the same manner, but one with better internasl than another, aren't the same; i.e., the program with better internals is the better one. Better internals mean more efficiency, faster, less bugs and the code organized to reproduce and find them. This means a good documentation and a way to generate and organize it. Because of this, I think OS/2 is not just an amount of code, but also the way IBM generates and organizes the documentation, and the way they use it. In this reasoning, OS/2 is also the way IBM develops it, and a clone will not be the same, however it does the same things.
